Flight Series Eyewear Terms of Service

These Terms of Service (“Terms”) govern all purchases and use of products sold by Flight Series Eyewear (“Company,” “we,” “us,” or “our”), including sunglasses, accessories, and related items (the “Products”). By purchasing, accepting delivery of, or using any Product, you (“you” or “Customer”) agree to these Terms. If you do not agree, do not buy or use the Products.

1. Nature of the Products
Flight Series sunglasses are consumer fashion and recreational eyewear. They are not certified aviation equipment, not FAA-approved flight gear, not OSHA or industrial safety eyewear, not medical devices, and not ballistic, military-specification, or laser-protective equipment.

All Flight Series sunglass models offered for sale are designed to meet ANSI Z80.3 requirements applicable to non-prescription sunglasses sold in the United States, including the FDA drop-ball impact provisions referenced for sunglasses under applicable federal regulations. ANSI Z80.3 is a sunglasses standard. It is not ANSI Z87.1 occupational safety eyewear, not a ballistic rating, and not a guarantee against eye injury.

2. Meaning of “Compatible,” “Pilot Polarized,” and Display Language
Words such as “compatible,” “MFD compatible,” “LCD compatible,” “digital-screen compatible,” “Pilot Polarized,” “cockpit-friendly,” or similar phrases mean only this:

The lenses use polarization intended to reduce glare while remaining usable with many multifunction displays (MFDs), LCD/LED instrument panels, phones, tablets, GPS units, and similar screens better than many traditional polarized sunglasses in some conditions.

Those words do not mean:

  • 100% screen clarity
  • no dimming
  • no color shift, rainbowing, washout, or distortion
  • readable screens at every angle, in every aircraft, or on every device
  • suitability as required flight equipment

Polarized light and electronic displays interact. Dimming, darkening, distortion, or partial obstruction can still occur depending on viewing angle, display type and orientation, lighting, windshields, coatings, and how you move your head. You must test the Product on your aircraft, vehicle, and devices before relying on it for any task. If a display is not acceptably readable, stop using the sunglasses for that task.

3. UV, Coatings, Frames, and Durability Claims
“UV400,” “UV protection,” “scratch-resistant,” “smudge-resistant,” “hydrophobic,” “oleophobic,” “Ri-PeX,” “Ri-Pix,” “Hydro Roll,” “impact-resistant,” “durable,” “TR90,” and similar phrases describe intended design features under normal use.

  • Scratch-resistant is not scratch-proof.
  • Smudge-resistant is not smudge-proof.
  • Impact-resistant under ANSI Z80.3 is not shatterproof, bulletproof, or ballistic.
  • UV-filtering lenses do not eliminate all risk of eye injury or long-term sun damage.
  • Frames and lenses can scratch, chip, crack, warp, loosen, or fail from drops, abrasion, chemicals, heat, modification, or wear.

4. Misuse and Loss of Integrity
Company is not responsible for damage, injury, or poor performance caused by misuse or by anything that compromises the integrity of the frames or lenses, including without limitation: cleaning with shirts, paper, solvents, or abrasives; contact with sand, tools, helmets, headsets, or bags; sitting on or bending the Product; heat (dashboards, aircraft decks); chemicals; aftermarket lenses or parts; attempted repair; or continued use after visible damage.

5. No Aviation, Driving, or Occupational Reliance
You alone decide whether the Product is appropriate. Do not use it as a substitute for required protective equipment, approved flight-crew eyewear, or any procedure in an AFM, POH, SOP, or company manual. Company does not warrant that the Product is safe or effective for flight, driving, tactical, industrial, or emergency work.

6. Assumption of Risk
To the maximum extent permitted by law, you assume all risk of use, including reduced screen visibility, glare, eye strain, frame or lens failure, and any accident or loss connected with aviation, driving, or other activity.

7. Disclaimer of Warranties
EXCEPT FOR ANY WRITTEN LIMITED WARRANTY COMPANY MAY PUBLISH AT THE TIME OF SALE (IF ANY), PRODUCTS ARE PROVIDED AS IS AND WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Product pages, ads, and social posts are general descriptions, not guarantees.

Some states do not allow certain warranty disclaimers. Those limits apply only to the extent required.

8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF USE, DATA, PROFITS, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT.

These limits apply to contract, tort, strict liability, and any other theory, except where prohibited (including certain personal-injury claims).

9. Indemnification
You will defend, indemnify, and hold harmless Company and its owners, officers, employees, and affiliates from claims, damages, losses, and reasonable attorneys’ fees arising out of: your use or misuse of a Product; your failure to test compatibility; your failure to follow care instructions; your violation of law or these Terms; or injury or property damage connected with the Product, except to the extent caused by Company’s willful misconduct.

10. Shipping, Lost Packages, and Returns
You must provide a correct shipping address. Company is not liable for loss caused by an address you provided incorrectly. If Company confirms a package was lost or not delivered, Company may, at its option, replace the order one time after you: (a) confirm the address was correct; (b) provide reasonable proof of non-delivery; and (c) show reasonable efforts to locate the package. Replacement ships by standard ground unless Company agrees otherwise. Return and refund rights are only those in the posted Return and Shipping Policy or required by law.

11. Intellectual Property and Reviews
Site content and Product designs are owned by Company or its licensors. You may not copy them except as allowed by law. If you submit a review or photo, you grant Company a non-exclusive, royalty-free license to use it for marketing.

12. Eligibility
You represent you are at least 18, or the age of majority, and have authority to bind yourself to these Terms.

13. Governing Law, Venue, and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue for disputes is the state or federal courts located in Texas You consent to personal jurisdiction there.

14. Entire Agreement; Severability; Waiver; Updates

These Terms, the posted Return Policy, Privacy Policy, and any written limited warranty on the site at purchase are the entire agreement and supersede prior statements, including ads. If a provision is unenforceable, the rest remains in force. Failure to enforce a provision is not a waiver. Company may update these Terms by posting a new version. Purchases after the new Effective Date are governed by the new Terms.

15. Acknowledgment
BY COMPLETING A PURCHASE OR USING A PRODUCT, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THAT “COMPATIBLE” DOES NOT MEAN PERFECT OR UNDIMMED SCREENS, UNDERSTAND THAT THE PRODUCTS ARE ANSI Z80.3 SUNGLASSES AND NOT BALLISTIC OR LASER GEAR, AND AGREE TO THESE TERMS.
